4. Services & Availability

Our Services are provided on an "as is" and "as available" basis without warranties of any kind, express or implied. We do not guarantee uninterrupted access and may modify, suspend, or discontinue any Service at any time without prior notice.

5. Credits, Payments & Refunds

Credits are digital tokens purchased through our payment processor (Stripe) and used to access certain features.
All purchases are final. Credits are non-refundable and non-transferable unless required by applicable law.
Credits do not expire while your account remains active. We reserve the right to adjust pricing with reasonable notice.
Prices are displayed in Swiss Francs (CHF) unless otherwise indicated. You are responsible for any applicable taxes.
We are not liable for unauthorized purchases made through your account.

6. AI-Generated Content

Certain Services use third-party AI models (e.g., Google Gemini) to generate content. We do not control the output and make no representations regarding its accuracy, completeness, or fitness for any purpose.
You are solely responsible for reviewing, verifying, and determining the suitability of any AI-generated content before using it, commercially or otherwise.
You may not use the Services to generate content that is illegal, defamatory, infringing, sexually explicit, violent, or otherwise harmful.
AI-generated content may be subject to the terms and usage policies of the underlying model provider.
We do not claim ownership of content you generate but reserve the right to remove content that violates these Terms.

7. Intellectual Property

All branding, design, code, and documentation of the Services remain the property of Atomic Apps. You retain ownership of content you create using the Services, subject to any applicable third-party licenses.

8. Acceptable Use

Do not attempt to gain unauthorized access to any Service, server, or network.
Do not use the Services for any purpose that is unlawful or prohibited by these Terms.
Do not engage in automated or excessive use that degrades the Services for others.
Do not resell, redistribute, or sublicense access to the Services without written permission.

9. Limitation of Liability

To the maximum extent permitted by law, Atomic Apps shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption. Our total aggregate liability is limited to the amounts you have paid to us in the twelve (12) months preceding the event giving rise to the claim.

10. Indemnification

You agree to indemnify and hold harmless Atomic Apps from any claims, damages, or expenses arising from your use of the Services, your violation of these Terms, or your violation of any third-party rights.

11. Governing Law & Disputes

These Terms are governed by the laws of Switzerland. Any disputes shall be resolved in the courts of the Canton of Zurich, Switzerland.

12. Modifications

We may revise these Terms at any time. Material changes will be communicated via the Services or email. Continued use after changes take effect constitutes acceptance of the revised Terms.

13. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall continue in full force and effect.

Privacy Policy

Google Gemini API — AI content generation. Prompts are transmitted to Google's servers for processing. Subject to Google's AI terms and data policies.

6. Data Storage & Retention

Primary data is stored on servers located in Switzerland and the European Union. We retain your personal data for as long as your account is active or as needed to provide the Services. Upon account deletion, we will remove or anonymize your data within 30 days, except where retention is required by law.

7. International Transfers

Some third-party processors may transfer data outside of Switzerland and the EEA. Such transfers are protected by appropriate safeguards, including Standard Contractual Clauses (SCCs) approved by the European Commission or equivalent mechanisms.
